Should Parents Face Charges For Letting Pitbull Kill Their Baby?

This past week a dog viciously attacked and killed a 6-month old baby girl in Las Vegas. The dog, a pitbull mix, has since been euthanized, as any dog involved in an attack cannot be adopted out. The family has since set up a GoFundMe page, seeking $10,000 in this sad time.

What seemed strange was that the family had had their pitbull for 9 years, and the dog had never bitten anyone prior to this incident. Police Officer Laura Meltzer told reporters that the child, identified as Kamiko Dao Tsuda-Saelee, had been playing in her baby walker when the dog attacked. The mother attempted to step in, but the damage had already been done. Kamiko was taken to the hospital and pronounced dead a short time later.

Police also said that they do not anticipate any charges being filed, calling the incident “a tragic accident”.

No one would call the attack anything other than an accident but does this mean the parents should get off scot-free?

Many terrible things that happen are accidents. We have laws against accidents. When someone buys a firearm, the purchaser is informed that they could face charges if a minor uses the weapon for a crime. That’s right! If the teenage son of a gun owner steals the gun and uses it in a shooting, the gun owner is also held responsible.

What is the difference between a firearm and a pitbull? Pitbulls have brains. Pitbulls are not inanimate objects. A gun cannot pick itself up and shoot someone. Guns need people behind them in order to be deadly. Pitbulls, however, do not.

There is precedent for punishing the owners of pitbulls when accidents happen.

  • 24 year old Zontae Irby was charged with a crime when his dogs mauled a 6-year old girl in Ohio.
  • 62 year old Derick Felton was given probabation after his dogs attacked a 51 year old man in Detroit.
  • Cameron Tucker was arrested after his dogs killed one girl and injured another in Atlanta.

So what is the rule? If your dog kills someone else’s kid, it’s wrong, but if they kill YOUR kid, its okay?
